BluFox Mobile – Unpaid Overtime Wages

Kessler Matura P.C. is co-counseling a collective action lawsuit against BluFox Mobile LLC and Chaitanya Krishna a/k/a Chetan Krishna that alleges violations of the Fair Labor Standards Act (“FLSA”).

The Complaint alleges that the defendants denied their Store Managers overtime pay. BluFox operates over 100 retail locations across 16 states selling Comcast Xfinity products and services. These Store Managers regularly worked over 40 hours per week, but were paid only a salary regardless of hours worked.

The lawsuit challenges BluFox’s practice of misclassifying Store Managers as exempt from overtime pay requirements. The Store Managers’ primary duties consisted of selling Comcast XFINITY services and products, processing incoming shipments and stocking, helping customers, troubleshooting phones, answering calls, and cleaning. Despite these non-managerial duties, defendants failed to pay overtime wages for hours worked in excess of 40 per workweek.

The lawsuit seeks to recover the workers’ unpaid overtime wages, liquidated damages, attorneys’ fees, and costs.

The case is pending in the United States District Court for the Eastern District of New York.
