Amerivents (Ryder Cup) – Unpaid Overtime and Tips
Kessler Matura P.C. filed a class and collective action lawsuit against Amerivents Catering LLC, alleging violations of the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL). Amerivents is a hospitality-staffing company. Plaintiff worked for Amerivents at the Ryder Cup at Bethpage Black, in Farmingdale, New York, in September 2025.
The Complaint alleges that Plaintiff and his coworkers (“Ryder Cup Workers”) worked in private, catered suites, serving food and drinks to suite attendees. The suite customers were charged 20% gratuity on top of the total bill, which was intended as compensation for the Ryder Cup Workers. Plaintiff and his fellow Ryder Cup Workers, however, allege that Amerivents never paid them these tips.
The Complaint also alleges that Amerivents offered the Ryder Cup Workers an attendance incentive bonus in which Ryder Cup Workers would receive additional pay for perfect attendance (“Attendance Bonus”). Amerivents, however, failed to pay and unduly withheld the Attendance Bonus from the Ryder Cup Workers, in violation of the NYLL. Further, Amerivents did not factor the Attendance Bonuses into the Ryder Cup Workers’ overtime rate calculation in violation of the FLSA and NYLL.
The case is pending in the United States District Court for the Eastern District of New York.
