Checkers Franchises – Late-Paid Wages and Scheduling Violations
Kessler Matura P.C., working with co-counsel, filed a class and collective action lawsuit against several Checkers franchises in New York City for violations of federal and state wage payment laws, as well as NYC’s Fair Workweek Law. The lawsuit alleged that JPJ Franklin LLC, Penn Burgers, LLC, and Sunrise Burgers, LLC failed to pay their hourly workers on time and violated scheduling requirements.
The complaint alleged that while Checkers wrote weekly paychecks, they only gave them to workers every two weeks – holding back one week’s pay longer than the law allows. New York law says workers like those at Checkers must be paid within seven days after their work weekends. The lawsuit sought to recover damages on behalf of workers who were affected by these delayed wage payments over the past six years.
The lawsuit also claimed these Checkers locations broke NYC scheduling laws by not giving workers enough advance notice of their schedules, making them work extra hours without proper approval or extra pay, and hiring new workers before offering more hours to current part-time employees. The case sought to recover unpaid premiums, compensatory damages, and attorneys’ fees for affected workers.

After defeating Defendants’ motion to dismiss on August 14, 2025, the case resolved when the Plaintiffs accepted Defendants’ offer of judgement.
