Citizens Options Unlimited – Unpaid Overtime
In March 2024, Kessler Matura P.C. and co-counsel filed a class and collective action lawsuit on behalf of current and former House Manager who worked for Citizens Options Unlimited, a non-profit organization that operates various facilities for people with disabilities throughout New York. The complaint alleged that House Mangers worked six to seven days per week and were on call 24/7, however, Citizens Options Unlimited failed to provide overtime pay. As a result, we alleged that House Managers are owed considerable unpaid overtime. This lawsuit sought to recover back wages and related damages to all individuals employed in New York since March 2024, who worked for Citizens Options Unlimited as House Managers.
The federal case was voluntarily dismissed the case in September 2024.
A class action settlement was approved by the Supreme Court of New York, Nassau County, in April 2025.
