The Pace Companies, Eaglestone, LLC, and Aterian Investment Partners – WARN Act Violations
On February 12, 2025, Kessler Matura P.C., along with co-counsel from the Sugar Law Center for Economic & Social Justice, filed a class action lawsuit in the United States District Court for the Eastern District of New York against Pace Plumbing Corp. and Eaglestone LLC for violations of federal and state WARN Acts. The lawsuit alleges that on February 6, 2025, the defendants abruptly terminated over 300 employees at their Brooklyn facility without providing the legally required advance notice. The employees were informed of their termination through a hybrid Zoom/in-person conference meeting and received termination letters the same day.
On March 13, 2025, we filed an amended complaint (available here) to add new details and defendants, expand the scope of the proposed class, and include claims brought by the unionized plumbers’ union and benefit funds. The amended complaint alleges that employees of Pace Field Services LLC (known as Pace Mechanical) and The Pace Companies New York LLC, along with the Pace Plumbing Corp. employees, were also unlawfully fired without sufficient notice or pay. The amended complaint also adds these entities as defendants and includes Eaglestone, LLC’s parent company, Aterian Investment Management, LP (also known as Aterian Investment Partners).

Virginia & Ambinder LLP represents the Trustees of the International Training Fund, Trustees of the Plumbers Local Union No. 1 Welfare Fund, Trade Education Fund, and 401(k) Savings Plan, and Trustees of the United Association National Pension Fund.
The lawsuit seeks damages for the over 300 affected workers and their benefit funds.
