Spartan Race & Tough Mudder – Unpaid Overtime Wages
Kessler Matura P.C. is co-counseling a collective action lawsuit against Spartan Race, Inc. and OCR US Holdings, LLC (d/b/a Tough Mudder) that alleges violations of the Fair Labor Standards Act (FLSA).
The Complaint alleges that the defendants denied their set-up and event crew overtime pay. These employees traveled to the defendants’ event sites where they worked 10+ hour days over the course of the two-week event cycles. Although they worked well over 40 hours during these workweeks, they were not paid any additional hourly overtime wages.
The lawsuit also challenges the defendants’ travel time compensation practices. Prior to July 2024, employees allegedly received no compensation for travel during business hours. After July 2024, they were limited to eight hours of travel pay regardless of actual travel time.
The lawsuit seeks to recover the workers’ unpaid overtime wages, liquidated damages, attorneys’ fees, and costs.
The case is pending in the United States District Court for the District of Delaware.
