New York City has put in place strong protections for food delivery workers who use apps. These rules ensure fair treatment and pay for all workers, no matter their immigration status.

Minimum Pay Requirements

Food delivery workers are entitled to a minimum hourly rate of $21.44 (excluding tips) for time spent making deliveries. This rate will see annual increases each April 1st. Apps must provide weekly payments with a no-fee payment option available.

Transparency in Pay and Tips

Delivery apps are required to provide:

  • Daily total pay and tips information
  • Detailed tip amounts for each delivery
  • Complete route details before delivery acceptance, including:
  • Pickup location
  • Estimated time and distance
  • Expected pay and tip

Worker-Controlled Route Settings

The law allows workers to choose their delivery routes by setting limits on which bridges or tunnels they use and how far they’ll travel between restaurants and customers. Apps must follow these choices and can’t give workers deliveries outside the areas workers pick. This helps workers control where they work and feel more comfortable on their routes.

Essential Equipment and Facilities Access

The law also ensures that workers have access to essential equipment and facilities. After completing six deliveries, workers are provided with free insulated food delivery bags to help maintain food quality during transport. Additionally, workers are granted access to restaurant bathrooms during pickup, although some exceptions may apply. These provisions aim to improve working conditions and support workers in performing their duties effectively.

Worker Protection and Enforcement

The law’s strong anti-retaliation provisions protect workers who exercise their rights. Workers whose rights have been violated may bring a lawsuit or file a complaint with NYC’s Department of Consumer and Worker Protection.
